HMB STREET FOOD TERMS AND CONDITIONS

This document outlines the Terms and Conditions associated with HMB STREET FOOD providing event services to you (the client).
 

EVENT PROPOSAL ESTIMATE

The Proposal and Estimate is for information purposes only and does not confirm your event. To confirm your event with HMB STREET FOOD, a deposit of 20% is required within 14 days of receipt of the proposal, unless otherwise negotiated. All deposits will be applied to the final invoice.
 

DEPOSITS

Deposits are non-refundable, with the exception of extenuating circumstances determined by HMB STREET FOOD.

GUARANTEED ATTENDANCE

Final guest count for an event must be received 10 full working days in advance. This count becomes your guaranteed number and is not subject to reduction. If attendance is more than 10% above the guaranteed number, we will make every effort to accommodate your group. However, we cannot guarantee availability of additional items as specified in the original order and will substitute accordingly.

LATE BOOKING

We encourage you to reserve and book your date as soon as possible. Dates will not be held or reserved until the estimated 20% non-refundable deposit is made. We reserve the right to refuse events that are requested late or exceed our capacity to provide service.

FINAL PAYMENT & LATE FEES

Accounts will be reconciled, and a final invoice issued by email within 14 days of the event date. Balance payment must be paid prior to service unless otherwise specified and arranged.

If payment is not received by the agreed date, HMB STREET FOOD reserves the right to charge a late fee of 5% per week on any outstanding balance.

CANCELLATION CLAUSE

If the event is cancelled, we retain the deposit. If an event is cancelled with less than 60 days’ notice, any additional charges incurred and revenue loss (if any) by HMB STREET FOOD up to the date of cancellation will be billed to the customer (i.e. administrative costs, event planning and organisation charges, any stock ordered/prepared, rentals that cannot be returned, and within 96 hours of the event the cost of the staff).

Deposits for cancelled events may be held for up to 1 year, to be put towards another catering event booked with HMB STREET FOOD. In the event of cancellation due to unforeseen circumstances (such as venue closure), the deposit may be transferable to another event date, subject to availability and agreement by HMB STREET FOOD.

UNUSED FOOD & BEVERAGE

Any leftover food or beverage remains the property of HMB STREET FOOD.

ALCOHOL

We reserve the right to request identification and/or to refuse service at any event. We reserve the right to close the bar service due to patron altercations.

CANCELLATION BY ACTS OF GOD AND/OR FAILURE TO PROVIDE SERVICE

HMB STREET FOOD shall have no responsibility or liability for failure to supply any service when prevented from doing so by strikes, accidents, Acts of God (i.e. flood, fire, wind, etc) or any other cause beyond the caterer's control. If your event is cancelled for any of these reasons, HMB STREET FOOD shall use reasonable efforts to re-arrange your event; however, no guarantee is made. Should your event be cancelled under this paragraph and HMB STREET FOOD be unable to re-arrange your event within a reasonable timeframe, your deposit will be refunded less any expenses already incurred by HMB STREET FOOD.
 

EVENT LOCATION & EQUIPMENT RESPONSIBILITY

You assume all responsibility for any damages or theft to property rented to you, caused by patrons, members, guests, or invitees. Rental of the location is your sole responsibility, and it is recommended that you confirm with the location that all necessary equipment/room are included.

You confirm and warrant that the event location is suitable for the event and holds all necessary consents, licences, insurances, and permissions (as applicable) for the event to take place and for HMB STREET FOOD to provide services. Evidence of such consent, licence, or permission shall be provided upon request.

 

You shall reimburse HMB STREET FOOD in full for any loss or damage due to failure to adhere to the above clause or due to the event location being unsuitable.

The client must ensure the provision of suitable access, power, and water supply where required. If additional equipment is needed for service (e.g. generators, tables), this must be arranged in advance and may be subject to additional charges.
 

CLIENT LIABILITY FOR GUESTS’ ACTIONS

The client is responsible for ensuring that guests behave appropriately. HMB STREET FOOD reserves the right to cease service if unsafe, aggressive, or inappropriate behavior occurs, with no liability for loss of service or refunds.
 

WEATHER & OUTDOOR EVENTS

For outdoor events, it is the client’s responsibility to provide adequate shelter for food service in case of adverse weather. If conditions are unsafe (e.g. high winds, extreme rain), HMB STREET FOOD reserves the right to refuse service without refund.
 

WASTE DISPOSAL

By agreeing to these Terms & Conditions, you confirm that HMB STREET FOOD is permitted to dispose of waste and rubbish on site unless otherwise agreed in advance. Waste may include food waste, packaging, and other refuse typically associated with hospitality service.

The client is responsible for providing adequate waste disposal facilities, including bins for customers to use. If prior arrangements are required for additional waste disposal services, an extra charge may apply. If sufficient waste disposal facilities are not provided, HMB STREET FOOD reserves the right to refuse service or charge an additional fee for waste removal.
 

INTELLECTUAL PROPERTY

Throughout the provision of service from HMB STREET FOOD and thereafter, we retain all intellectual property rights for our service or products. HMB STREET FOOD grants you a licence to use any promotional material provided in advance of your event. Should you wish to produce your own promotional material, this is permissible, provided that HMB STREET FOOD is credited and mentioned on all such material, whether on paper or digitally.

By entering into a contract (paying deposit) with HMB STREET FOOD, you are agreeing to these Terms & Conditions and acknowledge and agree that they shall be governed by the law of Scotland.
